Court fixes January 23, for hearing on alleged criminal conspiracy against Maikori, two others

The Chief Magistrate Court 3, Daura Road, Kaduna, on Monday fixed January 23, 2020, for hearing in the case of alleged criminal conspiracy, mischief and theft preferred against Yahaya Maikori, Suleiman Zubairu and Yola Yusuf Ltd, Kaduna.
They were alleged to have vandalised a house where they were tenants while packing out of the property located in Barnawa area of Kaduna.
The case was adjourned following a letter from the Kaduna State Attorney General to the State police commissioner, requesting that the First Information Report (FIR) disclosing the alleged offence against the defendants be terminated.
The presiding Judge, Bashir Shittu Yusuf who drew the attention of both the prosecuting and defence counsels to the letter, saying a copy was sent to the court.
However, the police prosecuting counsel, Mr. Omo-Osagie Monday, said he was not aware of the letter and prayed the court to be allowed to clarify with the Kaduna state police commissioner.
The letter which was dated November 13, 2019 and signed by Mr. Bayero Dari, Kaduna state Director of Public Prosecution, on behalf of the Attorney General, further requested that the three suspects be discharged pursuant to the provisions of section 125 (6) (e) of the Kaduna State Administration of Criminal Justice Law.
The letter however stated that the parties which are said to be embroiled in legal tussle following disagreements over business issues, were free to pursue the various civil suits filed in respect to the transaction to logical conclusion or resolved the issues amicably.
The FIR which the Attorney General requested for its termination reads:
“Criminal conspiracy, mischief and theft.
“On May 6, 2019, at about 9:00am, the above case was reported to the deputy commissioner of police, criminal investigation an intelligence department by one Aminu Aliyu,
No. 15, Ladan Street, Kimaye, Hayin Danmani, Kaduna, against one Yahaya Maikori of Echo Metro Estate, Lekki, Lagos state and one Suleiman Zubairu of No. 16, Francis Bagudu Estate, Barnawa Kaduna and Yola Yusuf Ltd, Kaduna.
“The complaint alleged that he sold a housing property located at No. 5, Keffi road, Barnawa, Kaduna to one Anzola Resources Ltd of Barnawa GRA, Kaduna sometimes in the month of March, 2019 and served the said suspects and his company with notice to vacate the property to hand over same to the said Anzola for possession, but to his dismay, in his the month of April 2019, he discovered that while the said suspects were packing out of the property, they vandalised the doors of the house, electrical fittings and other valuable items valued at N942,000 and made away with them to unknown destination. “Offence Suspects voluntarily confessed to have committed during investigation contrary to section 59, 313, 273 the Kaduna penal code law No 5, 2017.”
